  • “Licensed Seller”: The third-party licensed partner responsible for the sale and fulfillment of alcoholic goods.
  • “You”: The individual or legal entity accessing the Service.

2. Declaration of Agency & Contract Formation

2.1 Role of the Site: Zodiac Wine Co operates as an intermediary agent. We provide a platform for customers to browse and purchase products, but we do not physically hold, sell, or distribute alcoholic beverages.

2.2 Contractual Relationship: When you place an order, you enter into a direct, legally binding contract with the Licensed Seller. By placing an order, you authorize Zodiac Wine Co to act as your agent to conclude this contract. The Company is not a party to the specific contract of sale regarding the regulated handling of the product.

2.3 Identity of the Seller: To maintain transparency, the specific name and license details of the Licensed Seller responsible for your order will be provided on your Order Confirmation Email.


3. Third-Party Platforms (Base44)

3.1 Web App Operation: Certain sections of our site are operated through a web application powered by Base44. Use of this app requires users to create a separate account and login to the Base44 platform.

3.2 Data Governance: Zodiac Wine Co does not govern or control your data via the Base44 platform. Your data, security, and privacy on that platform are governed strictly by Base44’s own Terms and Conditions and Privacy Policy. The Company assumes no liability for the management, storage, or loss of data within the Base44 ecosystem.


4. Age Verification and Legal Requirements

4.1 Minimum Age: You must be at least 18 years of age to use this Service or purchase alcohol.

4.2 Challenge 25 Policy: All deliveries must be received by an adult. The Licensed Seller’s couriers operate a Challenge 25 policy. Valid photo ID (Passport, UK Driving License, or PASS-accredited card) will be required if the recipient appears under 25.

4.3 Refusal of Delivery: Delivery will be refused if:

  • The recipient cannot provide valid ID.
  • The recipient appears to be intoxicated.
  • If delivery is refused for these reasons, you remain liable for delivery charges and may not be eligible for a refund.

5. Delivery and Shipping

5.1 Delivery Area: We facilitate delivery to the United Kingdom. 5.2 Risk and Title:

  • Title: Ownership of the goods passes to you once payment is received and the order is dispatched.
  • Risk: Under the UK Consumer Rights Act 2015, the risk of loss or damage remains with the Licensed Seller until the goods come into your physical possession. 5.3 Delivery Failure: We are not liable for errors due to incorrect information provided by you. If a parcel is returned to us/the Licensed Seller after failed attempts, a redelivery fee will apply.

6. Damages, Shortages, and Refunds

6.1 Reporting Damage: You must inspect your order upon delivery. If goods are damaged or broken:

  • Contact hello@zodiacwine.co.uk within 24 hours.
  • You must provide photographic evidence of the damage and the packaging. 6.2 Statutory Right to Cancel: Under the Consumer Contracts Regulations, UK consumers have 14 days from delivery to withdraw from the contract, provided:
  • The bottles remain unopened and sealed.
  • The goods are in a resalable condition. 6.3 Non-Returnable Items: Due to health protection and quality standards, we cannot accept returns for any bottles that have been opened, unsealed, or have tampered labels. 6.4 Refund Processing: Refunds (excluding return shipping costs) will be processed within 14 days of the Licensed Seller receiving the returned goods.

7. Limitation of Liability

7.1 General: To the maximum extent permitted by law, the Company’s liability is limited to the purchase price of the goods. 7.2 Statutory Rights: Nothing in these terms excludes our liability for death, personal injury caused by negligence, or fraudulent misrepresentation, nor does it affect your statutory rights under the Consumer Rights Act 2015.


8. Intellectual Property and Acceptable Use

8.1 Ownership: All content, marks, and logos on the Service are the exclusive property of the Company or its licensors. 8.2 Prohibited Use: You may not copy, scrape, or exploit any part of the Service for commercial purposes without express written permission.


9. Governing Law and Jurisdiction

These terms are governed by the laws of England and Wales. Any controversy or claim shall be subject to the exclusive jurisdiction of the courts of England and Wales.
